UIQ Open Competition Terms and Conditions
Promoter
1. The Promoter of this competition is UIQ Technology AB of Soft Center VII, SE-372 25 Ronneby, Sweden (“Promoter”).
Entrants
2. This competition is open to people aged 18 or above at the time of entry and entry is not geographically restricted. However, we reserve the right to amend these terms and conditions to prohibit entry by residents of a country if it comes to our attention that this competition is illegal in that particular country.
3. This competition is not open to employees or contractors of the Promoter (or its related companies) or any person directly or indirectly involved in the organisation or running of the competition, or their direct family members.
How to Enter
4. No purchase or entry fee is required to enter the competition. To enter, you must be a registered member of the UIQ Developer Community. This registration is free of change. Please follow the guidelines on competition website on http://developer.uiq.com (“the Website”) and enter the required information, including your name, address and email address; alternatively if you are already registered with the UIQ Developer Community web portal, you can insert your user name, password and address. You must then insert your Application (as described below) where indicated; and submit the entry form as directed. You may enter as many times as you wish, using the user name and password allocated at registration. (or your UIQ Developer Community web portal user name and password) for subsequent entries.
5. You must also submit an application which meets the criteria outlined on the relevant section of the Website (“Application”). The Application criteria shall form a part of these Terms and Conditions.
6. The Application must be your own original work and must not infringe any party’s intellectual property rights or be submitted in breach of any obligations of confidentiality owed to another person. By entering the competition, you represent, acknowledge and warrant that the submitted Application is an original work created solely by you and that no other party has any right, title, claim, or interest in the Application.
7. Online entries must be made by the authorised account holder of the email address submitted at the time of entry. “Authorised account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
8. An entry will be invalid and void if the entry and entered Application do not comply with the above conditions or if the entry is illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, or obtained through fraud or theft.
9. The competition opens 12:00am midnight (GMT) on 15 November 2007 and all entries must be received by 11.59pm (GMT) on 31 December 2007. Any entry received after the closing date will be invalid. Proof of sending is not proof of receipt. The Promoter does not accept any responsibility for late or lost entries due to delays or malfunctions of the Internet; misdirected entries; any problems, delays or technical malfunctions of any telephone, broadband or other network or of lines, computer online systems, servers, computers, or other equipment or software; failure of any e-mail or entry to be received; or any damage to the entrant’s or any other person’s computer, other equipment or software resulting from downloading any materials or any e-mail transmissions as part of the competition.
Licence
10. By participating in this competition and submitting the Application in consideration of the chance to win a prize, you grant the Promoter a royalty-free license to use the Application for:
- internal use within the Promoter’s business,
- publication of screenshots and information on the Website and other websites where articles are published about UIQ Open,
- use of screenshots and information in any printed publications, promotional and advertising materials of the Promoter and its related companies,
- use on UIQ owned phones for demonstration at promotional events and business development meetings,
- inclusion as part of UIQ’s demo suites applications;
The Promoter will not use your Application in any way other than as set out above. Awarding of prizes
11. UIQ Technology will evaluate the finalists on the basis of merit and will select a maximum of 10 prize winners (2 winners per category (the number of prize winners may be less if fewer than 10 entries meet the entry requirements and are of sufficient quality to merit a prize, as determined by the panel in its sole discretion)). UIQ Technology’s decision is final and no correspondence will be entered into.
12. Each winner will be contacted by means of the contact details provided at the time of entry. The winners’ names will be announced on the website http://developer.uiq.com and http://www.uiq.com on 15 March 2008.
13. If a winner cannot be contacted through the details that he or she has provided, and does not contact the Promoter to claim the prize within three months of the announcement of the winning entries as detailed above, that entry will be deemed invalid. If a winning entry is deemed invalid or disqualified, or the entrant refuses the prize, the Promoter may, in its sole discretion, choose whether to award the prize to another participant and if so that prize will be awarded to a valid entry selected by UIQ Technology in accordance with the above criteria.
Prizes
14. A maximum of 10 prize winners will be selected (2 winners from each category). Each winner will receive a package of goods including
- An invitation to a UIQ Fast Track 2008 event
- 1 UIQ 3 phone of your choice (Sony Ericsson or Motorola)
- 1 Accredited Symbian Developer exam fee
- Handango – featured product placement, worth $1000
- Handmark - featured product placement, worth $1000
- Wirelexsoft - VistaMax IDE 2.0
Taxes, Custom and Excise Duty, and all other expenses not stated in these conditions are not included.
15. Prizes must be taken as stated. There will be no cash alternatives and the prize is not transferable or substitutable by the winner. The Promoter reserves the right to substitute any prize, in which case a prize of equal or greater value will be awarded.
Publicity
16. By entering the competition you consent to the publication by or on behalf of the Promoter of your name, country of residence and likeness on materials for publicity, advertising and promotional purposes worldwide and on the Internet (including on the Website and any other websites hosted by the Promoter and its related companies), for purposes relating to the promotion of the competition both before and after the closing date, for an unlimited time and without compensation. The Promoter may use the name of an entrant as a credit relating to that entrant’s Application.
Miscellaneous
17. The Promoter will not pass on your personal details to any other organisation without your permission, except for the purpose of awarding your prize if necessary.
18. You agree that the Promoter and its affiliates, agents and their employees, directors and shareholders assume no liability, and will be held harmless by you for any liability, for injuries, losses or damages of any kind to persons, including without limitation, death and property, resulting in whole or part, directly or indirectly, from the acceptance, possession, use or misuse of the prize or participation in the competition.
19. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission; destruction of, unauthorized access to or alteration of entries or entry forms; technical malfunction or failure of any communications system, computer servers or providers, computer equipment or software; technical problem or internet traffic congestion which results in a failure of an entry to be received; nor for damage to any person’s computer equipment related to or resulting from participation or the download of materials relating to the competition.
20. If for any reason the competition is not capable of proceeding as planned, the Promoter reserves the right, at its sole discretion, to disqualify any individual who has tampered with the entry process, and/or to cancel, terminate, modify or suspend the competition. If the Promoter elects to cancel the competition before the closing date, the Promoter will not retain any rights in the submitted Applications.
21. By entering this competition, you will be deemed to have accepted these rules and to agree to be bound by them. Failure to abide by any of these rules will disqualify you from taking part in the competition and the entry will be deemed invalid.
23. This agreement is governed by the Swedish law.
